Judge accuses Real Madrid of environmental crime over Bernabeu noise | Relief

Concerts at the Santiago Bernabéu are under threat. The head of the Court 53 of Madrid, Mónica Aguirre de la Cuesta, has accepted the complaint filed by the neighbourhood association Perjudicados por el Bernabéu. against the Real Madrid Estadio company and its sole administrator, José Ángel Sánchez PerianesRNE reports this.

The defendants were called to testify on October 24 and charged with the alleged environmental crime. The petition concerns all concerts held since April 26 last year, as it is clear that all of them exceeded the noise limits provided by municipal regulations and no measures were taken to limit the noise caused by major events at the Bernabéu stadium.

The accusation was not extended, as the neighbors wanted, to the city’s mayor, José Luis Martínez Almeida, and the environmental councilor, Borja Carabante, realizing that “It is not the court’s task to analyze the rightness of the recipient of the files.the sanctions imposed and their gradation, without any indication that any legal norm was clearly and obviously violated during the processing of the materials, which could fall under the criminal category of evasive explanations.”

In laying out the basis of the law, the judge considers that the Community of Madrid is the body that issues the permit for each concert, since the license issued to Real Madrid in 2019 did not reflect any use that was not for public use, sports. This means that each of the events requires a specific permit.

The neighbourhood association has several legal cases against the Bernabeu and several months ago they succeeded in getting measures taken against the construction of a car park in the area.

New measures agreed between the council and the club to reduce nuisance were announced this week. Concerts will have to finish at 11pm and the club will be responsible for cleaning the stadium area.
