AFIP makes official the extension of income and personal assets: who benefits

Federal Administration of Public Revenue (AFIP) Deadline for submission of affidavit and payment extended Taxes on profits and personal property corresponding to the fiscal period 2023. This measure, established through Ordinary Resolution 5516/2024 and published in the Official Gazette this Friday, aims to provide taxpayers with more time to comply with their tax obligations. This extension applies to individuals and undivided properties as per the provisions of General Resolution Nos. 975 and 2,151, including their amendments and supplements. Similarly, it includes subjects covered by General Resolution No. 4,468, its amendments and supplements, which regulates scheduled tax.

The decision to extend the deadline is based on several factors. First, General Resolution No. 4,172, its amendments and supplements, had already established expiration dates based on the expiration of the Unique Tax Identification Code (CUIT) of the taxpayer and/or the responsible party. In addition, General Resolution No. 4,468 established the procedure for determining and paying the assessed tax as provided in the Income Tax Law.

The National Executive Power sent to the Honorable Congress of the Nation a regulatory project (PEN message no. 20/24) that proposes Revision of income and personal property taxesEffective from fiscal period 2023. The project received half approval from the Honorable Chamber of Deputies on April 29, 2024 and is currently being processed at the Honorable Chamber of Senators, registered with the number 0002-CD- 2024.

Given this legislative context, the AFIP considers it necessary to implement measures that adjust the parliamentary deadlines for the enactment of laws and their impact on the annual settlement of the above taxes. For this reason, it was decided to extend the deadlines so that those responsible under the above regulations can submit sworn declarations and pay the balance resulting from the lien.

The Directorate of Legislation and the General Sub-Directorates of Legal Affairs, Collection and Taxpayer Services have participated in this decision. This resolution is issued in exercise of the powers conferred by Article 20 of Law No. 11,683 and Article 7 of Decree No. 618 of July 10, 1997.

“We confirm that the applications for the annual settlement of both taxes will be sent to the professional councils and trade chambers immediately after the approval of the project sent by the National Executive Branch (Palliative and Relevant Fiscal Measures),” the AFIP said through a statement.
