Delegates from all over the United States began arriving this Monday at the Fiserv Forum pavilion in the city of Milwaukee (Wisconsin) for the coronation of Donald Trump as the Republican Party’s presidential candidate. Colourful balloons are already placed on the roof and waiting for their moment. However, Trump has received a last minute gift before the convention begins. The judge in charge of the Mar-a-Lago papers case has annulled the former president’s indictment, archived the case and closed it due to an alleged formal flaw in the appointment of the prosecutor.
Trump was thus relieved – at least temporarily – of the case in which he was accused of dozens of crimes of concealing secrets and obstruction of justice for taking classified papers on their way from the White House. Most were recovered in a search at Mar-a-Lago, the curator’s mansion in Palm Beach (Florida).
His exemption followed a Supreme Court ruling that struck down the Washington and Georgia cases for election interference and also censured New York. The former president’s judicial horizon is slowly clearing, while his chances of returning to the White House after the presidential election on November 5 have become stronger.
The decision comes just two days after he suffered an assassination attempt and just before the Republican National Convention begins in Milwaukee, where he will formally become the party’s nominee for president and announce who will be on the ballot with him for vice president.
Trump suffered only minor injuries and the already iconic image of him in the moments after the attack — under the flag of the United States, with his fist raised and a call to fight — has reinforced the image of an oppressed, martyr and rebel he has cultivated among his base. “A lot of people say it’s the most iconic picture ever seen. At the same time, the former president has decided to moderate his speech and call for unity, in a wise move to expand his electoral base. “As we move towards unifying our country after the horrific events of Saturday, the dismissal of the illegal indictment in Florida must be the first step, followed immediately by the dismissal of the entire Witch Hunt,” Trump wrote in capital letters, on his social network, Truth. The former president demands that all cases against him be dropped. “The Democratic Justice Department coordinated all these political attacks, which are an election interference plot against Joe Biden’s political opponent, ME. Let’s unite to end all political manipulation in our justice system and make America great again!” he added. Trump’s call for unity is, apparently, to unite around himself.
The case was filed by federal judge Eileen M. Cannon, appointed by Trump himself Mar-a-Lago affair. In a stunning 93-page decision, he concluded that the appointment of special counsel Jack Smith violated the Constitution because he was neither appointed by the president (the attorney general did) nor confirmed by the Senate.
“The Constitution’s framers gave Congress a vital role in the appointment of top and bottom officials. That role cannot be usurped or usurped by the executive branch, whether in this case or any other, whether or not in a time of greatest national need,” its resolution states. The decision breaks all previous precedent in this regard, defending the legitimacy of appointments of special prosecutors by the Justice Department without going through the Senate.
The judge’s ruling is appealable, and it can be assumed that the prosecutor will appeal to a higher court. Higher courts have overruled previous rulings of the judge, who has almost always ruled in favor of the former president. Still, Cannon’s ruling will, at the very least, delay the case. The prosecutor’s office, during a hearing before the judge last month, vigorously refuted the thesis that the appointment was flawed. Moreover, they argued that even if the judge ruled in favor of Trump’s lawyers, the proper response would not be to dismiss the entire proceedings.
The Mar-a-Lago classified papers case exploded dramatically with the search of Trump’s mansion in Palm Beach (Florida) by FBI agents on August 8, 2022. It was formally charged with dozens of crimes in June of the following year. The former president was accused of handling hundreds of secret or classified documents that he took to his private residence, which is also a hotel and a social club, without permission when he left the White House in January 2021. When the US president leaves office, they come under the National Archives according to the law. He is also accused of refusing to return them when officials repeatedly asked him to do so. These resistances led to the aforementioned registry.
The judge initially set a provisional date for the trial to begin last May, but it was then postponed indefinitely. Now, with the new motion, the case has been closed and archived, Trump’s indictment has been unsealed and all hearings have been canceled. All this, while awaiting a possible appeal.
Meanwhile, the case drags on, and Trump marches toward the White House. If he regains office, he could have the impeachment dropped, even if a higher court rules that the judge’s decision to dismiss the case did not follow the law.
