New lawsuit against auto cartel accepted: brands affected

He Commercial Court No. 12 of Barcelona admitted to considering a second class lawsuit against car manufacturers Mercedes, Nissan and Toyota. Claim regarding car cartel casefor which several car brands would require illegally inflated the prices of their carsthereby causing harm to the consumer.

The Consumer and User Organization (COU) notes this decision, in which this is the second claim filed on October 19, 2023 against ten manufacturers and five of their parent companies. The plot stretches between the years 2006 and 2013in relation to the new car market.

The said court, having considered the claim and came to the conclusion that meets the formal requirements for its processingacknowledged the claim and passed it on to the relevant brands so that prepare a response within twenty days. The OCU, since this is a collective action carried out on its initiative, will appeal to possible victims, as specified in the Civil Procedure Law.

Among those who may be affected are those who bought cars of different brands for almost a decade: from June 2008 to August 2013 for Nissan vehicles, from March 2010 to February 2011 for the Mercedes brand. and from February 2006 to August 2013 for Lexus or Toyota vehicles.

New claim accepted for consideration

The anti-competitive practices of these and other brands have led the OCU to present a series of class action lawsuits, of which there are already six in total. Four of them have already been accepted for processing. The latter, against manufacturers such as Opel, Peugeot, Citroen, Fiat, Alfa Romeo, Lancia, Chrysler, Jeep and Dodge. After these illegal pacts, from which thousands of people suffered, The National Markets and Competition Commission has imposed sanctions against manufacturers and dealersand the Supreme Court confirmed the sanctions for famous “model scam”.

In total, the following brands were sanctioned: Citroen, Mitsubishi, BMW, Chevrolet, ChryslerFiat, Ford, General Motors, Dodge, Honda, Hyundai, Jeep, Kia, Mazda, Mercedes BenzNissan, Peugeot, Porsche, Renault, Seat, Skoda, Toyota, Volkswagen, Audi, Alfa Romeo, Land Rover, Lancia, Lexus, Opel and Volvo.
