TAD opens the case of Pedro Rocha and the RFEF Management Committee.

Opening a case of very serious misconduct will allow the CSD to temporarily suspend Rocha from office if he takes office as RFEF President on April 26, and to dismiss him if he is sanctioned by the TAD.

He Supreme Sports Council (CSD) received this Monday a resolution from Sports Administrative Court (TAD), in which the authority communicates its decision to initiate sanctions file on all members of the Management Board Royal Spanish Football Federation (RFEF) regarding possible very serious violation.

Sources in the CSD confirmed to EFE that their legal services are analyzing the contents of the 39-page resolution in order to decide next steps. Since this is a very serious violation, the Board of Directors of the CSD may agree to Rocha’s suspension in the event of the RFEF President taking office on April 26 and his dismissal if he is subject to sanctions by TAD, reports the legal portal “Usport” and reports Europa Press.

The TAD solution is a consequence complaint filed by Miguel Galan CastellanosPresident of the National Center of Football Coaches (CENAFE), against the manager and his president Pedro Rocha for exceed one’s duties.

Miguel Angel Galan announced on Sunday that he will appeal to the TAD against the announcement of Pedro Rocha as the sole candidate for the presidency of the RFEF. “warranties provided may not be valid” and since they were received “in alleged election fraud“.

Galan Castellanos argued in his application that the TAD is “competent” to hear his appeal under the provisions of Article 120.c) Sports Law 39/2022 in accordance with the provisions of Article 1.1.c) of Royal Decree 53/2014, which establishes the composition, organization and functions of the TAD, and in Article 21 of Order EFD/42/2024 whereby electoral processes in Spanish sports federations.

Castellanos, partner of the national football coach number 3.3325, confirms that he has the right and “legitimate interest” imagine yourself as “recurrent” depending on your pre-candidate status and “having a right” become president of RFEF.

“Proclamation of Mr. Rocha as the only candidate for the presidency of the RFEF affects the individual interests of Miguel Angel Galan Castellanos as a provisional candidate and eligible for the presidency of the RFEF in accordance with Article 17.3 of Order EFD/42/2024 of 25 January, which regulates the electoral processes of the Spanish sports federations, as there was alleged electoral fraud in the gathering of support for the candidacy of Mr. Rocha,” the statement said.

In addition, he emphasized that on April 4, 2024, the TAD received an appeal filed by Miguel Angel Galan Castellanos, David Galan Castellanos And Mario Otero Iglesias against the decision of the RFEF Management Commission, taken the day before, which called for the election of the RFEF President.

The appellants asked the TAD to accept their appeal and to quash the call for a special meeting to elect a new RFEF President without first “replacing by partial elections the estates of all members who have lost their status as members of the assembly, with particular regard to Luis Enrique Martinez And Jorge Wilda(former men’s and women’s football selectors respectively).

“Proclamation of Mr. Rocha as President of the RFEF without first resolving the election problem causes damage that cannot be compensated for provisional candidatesMiguel Galan, Carlos Herrera And Eva Parera“, he notes.

He also recalled that the appeal was not resolved following the summons of the Electoral Commission dated April 5, 2024, also filed by Miguel Angel Galan Castellanos: David Galan Castellanos And Mario Otero Iglesiasand indicated that the support presented by Pedro Rocha was obtained as a result of “alleged electoral fraud” in violation of the duty of neutrality on the part of some members of the Management Commission and all territorial football presidents.

The statement contains statements Joan Soteras Vigomember of the aforementioned Management Commission, in a media outlet in which he publicly speaks in favor of the candidate Pedro Rocha”breach of duty of neutrality giving weight to the voices of the members of the Catalan Assembly and the rest of Spain.”

Likewise, he states that over 42 approvals submitted by Pedro Rocha ‘expired’ because many did not have a license issued by the RFEF, so “they lost their status as members of the assembly” since possession of a valid license is a condition for qualification and inclusion in the electoral roll.

In connection with all of the above, Miguel Angel Galan asked the TAD to accept the appeal and recognize it against resolution number seven of the RFEF Electoral Commission (proclamation of Pedro Rocha as the sole candidate for the presidency of the RFEF) and cancellation of the resolution agreed because endorsements submitted by a candidate are invalid because they have expired or because they were obtained as a result of alleged election fraud.

According to the legal portal “Yusport”, TAD rejected the appeal against calling elections for the presidency of the RFEF, given that some members, such as former national selectors Luis Enrique Martinez and Jorge Wilda, have not yet lost their status as members of the assembly and have voting rights.
